Acceptable Use Policy
- Effective Date:
- Last Updated:
This Acceptable Use Policy ("AUP") describes prohibited uses of the Services provided by Taxably, Inc. ("Taxably", "we", "us"). It supplements and forms part of the Terms of Service. By using the Services you agree to comply with this AUP and to ensure that everyone in your firm who accesses the Services does the same.
We enforce this AUP through technical controls, account review, and (if needed) suspension or termination. Most enforcement is reactive and follows a notice-and-cure process; the cases listed in Section 4 give us discretion to act first.
1. Lawful use
You will use the Services only for lawful tax-preparation, tax-advisory, and adjacent professional activities by or under the supervision of licensed tax professionals in the United States. You will not use the Services to violate any law or regulation, including but not limited to IRC § 7216, the Gramm-Leach-Bliley Act, the FTC Safeguards Rule, or any state tax preparer registration regime.
2. Authorized use of taxpayer information
You will only process taxpayer documents and information for which you have the authority to engage a third-party processor under IRC § 7216 (where applicable), under your engagement agreement with the taxpayer, and under any other applicable consent or contractual requirement. Taxably is your service provider; you are responsible for obtaining any required consents from your clients.
You will not upload to the Services any document of a person with whom you do not have a current engagement relationship.
3. Prohibited content and activity
You will not, and will not allow any user under your account to:
- Upload malware, ransomware, exploit code, or any file engineered to compromise the Services or other users.
- Attempt to gain unauthorized access to the Services, any other customer's data, or any underlying system; perform vulnerability scanning, penetration testing, or red-team activity without a written agreement with Taxably.
- Interfere with or disrupt the Services, including by overloading, flooding, scraping at unreasonable rates, or attempting denial of service.
- Use the Services to send unsolicited bulk communication (spam), or to harvest email addresses or other contact information for that purpose.
- Reverse-engineer, decompile, or disassemble the Services or any component (including the Taxably Connect desktop application or the prep-sheet renderer), except to the extent expressly permitted by applicable law.
- Train, fine-tune, or evaluate any machine learning model using output from the Services, except for the limited internal use of observing the Services' own behavior for engagement-quality review.
- Resell, sublicense, or otherwise commercialize the Services or Taxably's deliverables to third parties without written agreement.
- Use the Services to impersonate any person or entity, or to misrepresent your affiliation with any person or entity.
- Use the Services to facilitate fraud, tax evasion, or any other unlawful scheme.
- Circumvent or attempt to circumvent any usage limits, plan caps, rate limits, or security mechanisms.
4. Cases where we may act immediately
We may suspend or terminate access without prior notice when, in our reasonable judgment, you or a user under your account is:
- Engaged in activity that creates an imminent risk of harm to the Services, other customers, or third parties.
- Engaged in activity that is illegal under applicable law.
- Subject to a credible third-party claim or court order requiring immediate cessation.
- Operating with credentials that we believe in good faith have been compromised.
Where feasible, we will provide notice and an opportunity to cure; where not feasible (e.g. active credential compromise), we will notify after acting.
5. Reporting violations
Report suspected AUP violations to security@taxably.ai. Include the
firm name, the affected user account if known, a description of the
activity, and any supporting artifacts (URLs, log entries,
screenshots). We will acknowledge receipt within two business days
and investigate.
6. Changes
We may update this AUP from time to time. Material changes will be notified by email or in-app notice at least 30 days before they take effect. The "Last Updated" date at the top of this AUP reflects the most recent revision.
